The preliminary complaint is addressed to the criminal investigation officer or prosecutor by the injured person only or by procurator (the mandate must be special, and remain attached to the complaint). If written, the complaint must be signed by the injured party or procurator.
The complaint can also be made orally, and its content will be recorded in a report written by the one who receives it.
The complaint can be transmitted electronically, by e-mail, but only if it is certified by electronic signature.
Information that must be included in the complaint: name, personal identification number, address, description of the act which is the object of the complaint, name of the perpetrator, and evidence.
The preliminary complaint must be filed within three months from the day the injured party found out about the crime. “When the injured party is a minor or incapacitated person, the period of three months starts from the date when his legal representative found out about the crime.
