Today, the deputies voted, in unanimity, the request to amend Law 217/2003 for the prevention and control of domestic abuse, initiated by the independent deputy Remus Cernea. The project strengthens the authority of the emergency protective order, imposing more drastic measures for those who abuse their relatives. The regulation compels the assailant to check in at the police station and to offer information regarding his new home, if he was evacuated from his homely residence, to the authorities.
Thus, after article 23 paragraph 3, paragraph 4 was introduced, with the following contents:
“(4) Through the same decision, the court can set a control measure for the conformation to the protective order and for the prevention of its violation, such as:
a) coercing the assailant to periodically check in at the competent police station regarding the supervision of the protective order, within the time period specified by the court, according to the circumstances;
b) coercing the assailant to give information to the police body regarding his new home, if the court ruled his evacuation from his homely residence.”
Even though this amendment is a beneficial one, the issues with the protection of the victims of domestic violence still remain bound to absolutely necessary amendments to the Criminal Code and to the application of article 202 of the Procedural Criminal Code which allows the police and prosecutors to issue detention ordinances on the spot, removing immediate danger.
Three years ago, we began the chain of legal amendments and we will continue to fight everyday so that our projects will reach the Official Journal in the end and to be beneficial to the victims of domestic abuse.
