The Senate Gives a Favorable Opinion for Amending the Criminal Code

plen

Today, June 16, 2015, the legislative proposal to amend Law 286/2009 regarding the Criminal Code (L272/2015) was adopted with an unanimous favorable opinion by the Committee for Legal Matters, Discipline, and Immunities of the Senate.

This legislative proposal to amend the Criminal Code was initiated by Necuvinte Association, with the legal support of the Țuca Zbârcea & Asociații law firm and submitted in March 2015.

Inițiative supported by: Andronescu Ecaterina – PSD senator; Bădălău Niculae – PSD senator; Biró Rozalia-Ibolya – UDMR senator; Burlea Marin – UNPR senator; Butnaru Florinel – PSD senator; Chiuariu Tudor-Alexandru – PNL senator; Creţu Gabriela – PSD senator; Federovici Doina-Elena – PSD senator; Firea Gabriela – PSD senator; Haşotti Puiu – PNL senator; Iovescu Ioan – PP-DD senator; Jipa Florina-Ruxandra – UNPR senator; Lazăr Sorin-Constantin – PSD senator; Pavel Marian – PSD senator; Pop Gheorghe – PSD senator; Popa Constantin – UNPR senator; Popa Nicolae-Vlad – PNL senator; Saghian Gheorghe – PSD senator; Tătaru Nelu – PNL senator; Ştefănescu Elena Cătălina – PSD deputy.

The request to amend art. 193 “Assault and battery” and art. 194 “Bodily harm” of the Criminal Code, namely to reduce the number of days of medical care to 30, as it is currently set to 90 days.

In 2014, nationwide, 11,937 criminal acts falling under the rule of art. 193 “Assault and battery” were referred, and only 276 convictions were made.

“This legislative change will create a profound change in the legal system regarding the investigation of acts of violence and will lead to an increase in the number of convictions. For the women victims of domestic violence who fear for their lives and safety and withdraw their complaints to the police, our request will show that they are not alone and that justice is on their side. “ – Necuvinte Association

After the parliamentary recess, the proposal will enter into discussions in the committees of the Chamber of Deputies, the decision making chamber.
